It includes information that you have provided to us or was collected by us from other sources. It may include details such as your name and address, age and gender, personal financial records, identification numbers and personal references, to the extent permitted by local laws.
We greatly respect your privacy, which is why we make every effort to provide a platform that would live up to the highest of user privacy standards. Please read the Privacy Policy carefully. By using, accessing and/or visiting the Sites, you accept and agree to the Privacy Policy. You can exercise your rights by contacting us at privacy@streamelements.com. Subject to legal and other permissible considerations, we will make every reasonable effort to honour your request promptly or inform you if we require further information in order to fulfil your request. When processing your request, we may ask you for additional information to confirm your identity and for security purposes, before disclosing the Personal Data requested to you. We reserve the right to charge a fee where permitted by law, for instance if your request is manifestly unfounded or excessive.
In the event that your request would adversely affect the rights and freedoms of others (for example, would impact the duty of confidentiality we owe to others) or if we are legally entitled to deal with your request in a different way than initial requested, we will address your request to the maximum extent possible, all in accordance with applicable law.
The services provided by StreamElements (the "Services") are not intended for children under the age of 13 years. Accordingly, we do not intend to collect Personal Data from anyone we know to be under 13 years. For users in the European Economic Area, the relevant age is 16 (or the lower age of digital consent adopted by the relevant EU member state), unless we have obtained verifiable parental consent. If we learn that we have collected Personal Data from a child under 13 years, we will delete that information as quickly as possible. Some activity on or through the Services may be public by default. This may include content that you post publicly on the Site or otherwise through the Services. If you are a registered user, some of this information may be associated with your Account. If you are not a registered user, information about your use of the Services, such as the pages you visit, may be tracked anonymously through cookies and stored by us. Please remember that if you choose to provide Personal Data through public features of the Services, that information may be governed by the privacy settings of those features and may be publicly available. Other individuals may use or disclose publicly available information without our control or your knowledge, and search engines may index that information. We therefore encourage you to consider carefully whether to include information you regard as private in content you create or submit through the Services.
Should you ever decide to delete your Account, you may do so by emailing privacy@streamelements.com. If you terminate your Account, any association between your Account and information we store will no longer be accessible through your Account. However, given the nature of sharing on the Services, any public activity on your Account prior to deletion will remain stored on our servers and will remain accessible to the public. In addition to our normal procedure for stored data deletion, you can revoke our access to your data via the Google security settings page, at https://security.google.com/settings/security/permissions.
The Site may enable you to interact with or contain links to your Third Party Account and other third party websites, mobile software applications and services that are not owned or controlled by us (each a "Third Party Service"). We use the YouTube API Services. We are not responsible for the privacy practices or the content of such Third Party Services. Please be aware that Third Party Services may collect Personal Data from you. Accordingly, we encourage you to read the terms and conditions and privacy policy of each Third Party Service that you choose to use or interact with.
We may make use of log files. The information inside the log files includes internet protocol (IP) addresses, type of browser, Internet Service Provider (ISP), date/time stamp, referring/exit pages, clicked pages and any other information your browser may send to us. We may use such information to analyze trends, administer the Site, track users' movement around the Site, and gather demographic information.
Our Site may utilize "cookies", anonymous identifiers and other tracking technologies in order to for us to provide our Site and present you with information that is customized for you. A "cookie" is a small text file that may be used, for example, to collect information about activity on the Site. Certain cookies and other technologies may serve to recall Personal Data, such as an IP address, previously indicated by a user. Most browsers allow you to control cookies, including whether or not to accept them and how to remove them. You may set most browsers to notify you if you receive a cookie, or you may choose to block cookies with your browser.
If you are a California resident, you have the right to: (i) know and access the categories and specific pieces of personal information we collect, use, disclose, sell, or share, and the purposes for doing so; (ii) request deletion of personal information we have collected from you; (iii) correct inaccurate personal information; (iv) opt out of the sale and sharing of your personal information; (v) limit the use and disclosure of your sensitive personal information; and (vi) not receive discriminatory or retaliatory treatment for exercising these rights. To exercise these rights, contact us using the methods in the "Contact Us" section below; you may also use an authorized agent. We will acknowledge your request within 10 business days and respond within 45 days (which we may extend once by a further 45 days with notice), after verifying your identity. We do not knowingly sell or share the personal information of consumers under 16 years of age without opt-in consent (and, for those under 13, parental consent).
California Civil Code Section 1798.83 permits our customers who are California residents to request certain information regarding our disclosure of Personal Data to third parties for their direct marketing purposes. To make such a request, please send an email to privacy@streamelements.com. Please note that we are only required to respond to one request per customer each year.
We honour opt-out preference signals, including the Global Privacy Control (GPC). When we detect a GPC signal from your browser or device, we treat it as a valid request to opt out of the sale and sharing of your personal information for that browser or device. You may also opt out at any time via the "Do Not Sell or Share My Personal Information" link on our homepage. Some third-party analytics and advertising technologies we use may constitute a "sale" or "sharing" of personal information under California law; where they do, you may exercise the opt-out described above.
If you are a California resident under the age of 18 and a registered user, California Business and Professions Code Section 22581 permits you to remove content or Personal Data you have publicly posted. To remove, please send an email to privacy@streamelements.com. Please be aware that after removal you will not be able to restore removed content. In addition, such removal does not ensure complete or comprehensive removal of the content or Personal Data you have posted and that there may be circumstances in which the law does not require us to enable removal of content.
